Please take the time to read these Purchase Terms and Conditions. By using Our Website, the Services and information offered on Our Website and placing an order with CompuCare through the CompuCare website, you are agreeing to this Online Purchase Terms and Conditions.

In these Terms & Conditions

Company/We/Us means CompuCare

Customer/You means the organisation or person who purchases Goods from the Company.

Goods means all goods sold and/or delivered by the Company to the Customer.

“The contract is agreed” – by completing and submitting an electronic order form, customer is making an offer to purchase products which, if accepted by us, will result in a binding contract. An acceptance email from us confirms that the contract is formed.

By using the website to buy products online, you confirm that you are at least 18 years old.

Ordering

When ordering online you provide us with your name, address, email address, telephone number, which allow us to process the transaction. After your order has been placed, you will receive an email confirming the purchase and delivery address. If no confirmation email is received by you, there may be a problem with your email address, or verifying the transaction.

By completing and submitting an electronic order form, you are making an offer to purchase goods which, if accepted by us, will result in a binding contract.

Please note that if you use bank transfer or PayPal payment, products will not be sent until we have authorization your payment issuer. We will not be liable if there is a delay, and we will not accept your order if payment is not authorized.

After you have placed your order, you will receive an email to acknowledge your order. It will confirm which products you have ordered. This email is not an order acceptance from us.

We do not have to accept your order, and for example, we will not accept your order if:

  • We do not have the products in stock
  • Your payment is not authorised
  • There is an error on our website regarding the price or other details of the products
  • You have cancelled it in accordance with the cancellation instructions below

We reserve the right to refuse any order.

Cancelling an order before the product has been sent

If you change your mind after placing an order, you can cancel it at any time before we send it. You need simply reply to the confirmation email to cancel your order before delivery time.

Pricing and Availability

At times, and despite our best efforts, an error may occur and goods may be either incorrectly priced or described. In which case, we will not be obliged to supply the item at the incorrect price or in accordance with the incorrect description. We reserve the right to correct any errors. We will either cancel your order and refund the price or inquire whether you wish to continue with the order at the correct price or correct description. If we are unable to contact you, or you do not wish to continue with the order at the correct price or correct description, we will cancel your order and refund the price you have paid.

Not all goods are always available and while we try to keep as many items in stock, due to unforeseen circumstances we may run out of stock.

We reserve the right to update prices.

All goods are subject to availability. Where goods are out of stock or no longer available to us, we will refund you the price paid for those goods, or at our discretion, create a credit to you for that amount.

Prices throughout the website are quoted in Australian dollars, and payment can only be accepted in Australian Dollars. Packing and delivery costs, if any, will be added to the total price of your purchase.

While we make every effort to ensure that the products shown on our website are currently available at the price shown, we cannot guarantee that this will always be the case. If products you have ordered are unavailable, you will be notified as soon as possible.

Where an offer mentions that an item is reduced in price, eg: half-price, the discount will be calculated at checkout before any postage or packaging charges are applied.

Privacy Policy

Our privacy policy, which sets out how we will use your information, can be found at Privacy Policy. By using this Website, you consent to the processing described therein and warrant that all data provided by you is accurate.

Display, Description and Samples

Any display product or sample inspected by the Customer is solely for the Customer’s convenience and does not constitute a sale by sample.

Any description given or applied to the Goods is given by way of identification only and the use of such description shall not constitute a sale by description. For the avoidance of doubt, the Buyer hereby affirms that it does not in any way rely on any description when entering into the contract.

Title

Title in the Goods shall not pass to the customer until we have been paid in full in cash or cleared funds for the Goods.

Risk and Insurance

The Goods are entirely at the risk of the Customer from the moment of delivery to the Customer’s point of delivery or on collection, even though title in the Goods has not passed to the Customer at that time.

The Customer must, at its own expense, maintain the Goods and insure them for the benefit of the Company against theft, breakdown, fire, water and other risks as from the moment of delivery to the Customer and until title in the Goods has passed to the Customer.

Limited Liability

The Customer acknowledges that the Company is not:

(a) responsible if the Goods do not comply with any applicable safety standard or similar regulation; and

(b) liable for any claim, damage or demand resulting from such non-compliance.

Delivery information

You are able to choose the shipping method at the time you are placing the order. The shipping price will be added to the total price.

The Customer must collect or accept delivery of the Goods and pay the balance of the invoice price.

If the Customer fails to collect the Goods or accept delivery, the Company may terminate this contract, keep the deposit and resell the Goods.

The Company reserves the right to deliver the Goods in whole or in installments, as well as to deliver prior to the date for delivery and, in such event, the Customer must not refuse to take delivery of the Goods.

We will email you as soon as your order has been shipped.

Warranty

All Goods supplied are covered by such warranties as are specified by the manufacturer and supplied subject to the product standards detailed by the manufacturer.

On discovery of any defect in the Goods, the Customer must immediately notify the Company in writing of such defect. The Customer must not carry out any remedial work to alleged defective Goods without first obtaining the written consent of the Company to do so.

The Customer expressly acknowledges and agrees that it has not relied upon, and the Company is not liable for any advice given by the Company, its employees, agents or representatives in relation to the suitability for any purpose of the Goods.

Refund Rights

We are not required to provide a refund or replacement if you change your mind about what you bought.

But if the item you bought had a major problem, you can choose a refund or exchange. A major problem is when the item:

  • has a problem that would have stopped you from buying it if you had known about it
  • is unsafe as a result of the problem
  • is significantly different from the sample or description
  • doesn’t do what we said it would, or doesn’t do what you asked for and can’t easily be fixed.

If the problem is not major, we will repair the item within a reasonable time or give you a refund or replacement.

Please keep your proof of purchase, for example, your receipt.

Force Majeure

The Company will not be liable for any breach of contract due to any matter or thing beyond the Company’s control including but not limited to transport stoppages, transport breakdown, fire, flood, earthquake, acts of God, strikes, lock-outs, work stoppages, wars, riots or civil commotion, intervention or public authority, explosion or accident.

Governing Law

These terms and conditions are governed by and construed in accordance with the laws of South Australia, Australia. Any disputes concerning this website are to be resolved by the courts having jurisdiction in South Australia.

We retain the right to bring proceedings against you for breach of these Purchase Terms and Conditions, in your country of residence or any other appropriate country or jurisdiction.

Changes

The content of this Purchase Terms and Conditions may be updates from time to time, so we suggest that if you return to this website on a regular basis that you carefully read the information provided.
